TERMS & CONDITIONS – DESERT EMERALD

Welcome to Desert Emerald. These Terms & Conditions apply when you use our website or purchase products from us.

By placing an order with Desert Emerald, you agree to these Terms & Conditions. Nothing in these terms affects your statutory rights under UK consumer law.

1. ABOUT US

Desert Emerald is an independent UK online retailer offering fragrances, beauty products, home fragrance and related products.

2. PRODUCTS

We take reasonable care to ensure that product descriptions, photographs, prices and other information displayed on our website are accurate.

Product packaging, colours and appearance may occasionally differ slightly from photographs shown online.

All products are subject to availability.

3. ORDERS

When you place an order, you will receive an order confirmation.

We reserve the right to refuse or cancel an order where there is a genuine reason to do so, for example where a product is unavailable, there has been an obvious pricing error, payment cannot be authorised, or we reasonably suspect fraudulent activity.

If we cancel an order after payment has been taken, the relevant amount will be refunded.

4. PRICES & PAYMENT

All prices are displayed in British Pounds (GBP).

The total price, including applicable delivery charges, will be displayed before you complete your purchase.

Available payment methods are shown at checkout and may include debit or credit cards, PayPal, Klarna, Shop Pay, Apple Pay, Google Pay and other payment methods made available through our payment providers.

5. SHIPPING & DELIVERY

We currently deliver within the United Kingdom.

Standard and Express delivery options and their applicable charges are displayed at checkout.

Free standard UK shipping may be available when the order meets the qualifying order value shown at checkout.

We also offer Local Delivery to selected areas, subject to postcode eligibility. Local delivery prices and any minimum order requirements are displayed at checkout.

Where Same Day Local Delivery is offered, orders placed before the stated cut-off time will normally be delivered the same day. Orders placed after the cut-off will normally be delivered on the next available delivery day.

Delivery dates and times are estimates unless we expressly state otherwise.

6. CANCELLATIONS & RETURNS

For most goods purchased online, UK consumers have a legal right to cancel within 14 days after receiving the goods, subject to applicable exceptions.

You may also have additional rights under our Return & Refund Policy.

For hygiene and health-protection reasons, certain sealed goods may not be eligible for return after the seal has been broken where the applicable consumer law permits this exception.

This does not affect your statutory rights if an item is faulty, damaged, not as described or otherwise does not conform to your legal rights.

7. DAMAGED, FAULTY OR INCORRECT ITEMS

Please contact us as soon as reasonably possible if your order arrives damaged, faulty or incorrect.

We will assess the issue and provide an appropriate remedy in accordance with your rights under UK consumer law.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited. UK businesses cannot contract out of responsibility for faulty or misdescribed goods.

8. FRAGRANCES, COSMETICS & PERSONAL CARE PRODUCTS

Please read all product information, ingredients, warnings and usage instructions before using a product.

Discontinue use if irritation or an adverse reaction occurs and seek appropriate professional advice where necessary.

Product preferences such as fragrance strength, scent perception or personal preference can vary between individuals and do not, by themselves, mean that a product is faulty.

9. PROMOTIONS & DISCOUNT CODES

Promotional offers and discount codes may be subject to specific conditions.

Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be combined with other promotions.

We may withdraw or amend a promotion where reasonably necessary, but this will not affect orders already validly placed under that promotion.

10. INTELLECTUAL PROPERTY

Content created for the Desert Emerald website, including Desert Emerald branding, logos, original photographs, graphics and written content, may not be reproduced or used commercially without permission, except where such content belongs to a third party.

Third-party trademarks and brand names appearing on our website remain the property of their respective owners.

11. LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or losses arising from circumstances for which we are not legally responsible.

These limitations do not affect your statutory consumer rights.

Personal information is handled in accordance with our Privacy Policy.

Payments may be processed by third-party payment providers. Their own privacy policies and terms may also apply when you use their services.

13. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time.

Any changes will apply to future use of our website and future orders and will not retrospectively change the terms applicable to an order already placed.

14. GOVERNING LAW

These Terms & Conditions are governed by the applicable laws of the United Kingdom.

Nothing in these Terms is intended to restrict any rights you may have to bring proceedings in a court available to you under applicable consumer law.
